1. HOW LONG DO I HAVE TO RECOVER MY JUDICIAL JUDGMENT?

In California, a judgment is enforceable for a period of ten (10) years and can be renewed for an additional 10 years.

2. WHY SHOULD I USE AN ATTORNEY?

Some collection cases involve difficult legal questions beyond the competence of the ordinary lay person. Depending upon the nature of debtor assets and other facts, debt collection requires broad knowledge of the California Commercial Code and federal Bankruptcy Code, community property, probate, real estate law, and other specialized areas. In addition, if a consumer debt is involved, knowledge of an array of consumer protection statutes is required.

Moreover, attorneys are licensed by the State Bar and must abide by Rules of Professional Conduct. Disciplinary action is a matter of public record. Attorneys are required to keep their business address current and on file with the State Bar. Attorneys are permitted to discuss your collection case with you whereas other debt collectors are prohibited by law from doing so.

3. WHAT IF I HAVE AN ATTORNEY?

Some attorneys only handle the litigation portion of a case. Many attorneys do not handle the judgment enforcement portion of the case. Judgment enforcement is a time intensive area and many attorney’s choose not to engage in this area. In fact, many attorney-client agreements provide that attorney services end upon obtaining a judgment.

If you have paid a retainer to an attorney who has won a judicial judgment in your lawsuit, you can simply ask the attorney to stop work on the case and choose to have Balis Judgment Enforcers collect the judgment for you.

4. WHY SHOULD I NOT USE A COLLECTION AGENCY?

There are several reasons why you shouldn't. First, a collection agency has a very limited range of tools. A collection agency cannot practice law. Only active members of the State Bar are authorized to practice law in California. Thus, collection agency practice is limited to activities such as sending collection letters, making telephone calls and listing debts on the debtor's credit report.

Moreover, the 'Fair Debt Collection Practices Act' gives a debtor the power to ask a collection agency to stop calling. Further, a collection agency has no power to take money or property from a debtor. Balis Judgment Enforcers has a wide range of resources and technologies available for seizing money, assets and property to satisfy your court awarded judgment.

Second, a collection agency only specializes in collecting debts, NOT judgments that have already been awarded in court. In fact, most collection agencies outsource judicial judgments to an attorney for enforcement and recovery.

Third, a collection agency will not take your case if it isn't immediately convinced it can easily recover your money. Balis Judgment Enforcers, on the other hand, is patient and resourceful. We know that sometimes a debtor is difficult to locate and even hide assets. We continuously monitor cases to find debtors and their assets.

Finally, if you are a business, many collection agencies require you to establish an account and/or have a minimum number of cases assigned to them. 5. WHAT IF I HAVE ALREADY CONTRACTED WITH A COLLECTION AGENCY?

Unless you have sold your case to a collection agency, you can request that your case be returned to you. Once your judicial judgment is returned to you, Balis Judgment Enforcers will be right here to enforce and enforce your judgment for you.

6. WHY SHOULD I NOT USE A JUDGMENT RECOVERY SPECIALIST?

A judgment recovery specialist is a layperson that has gone into business to recover judgments on an assignment basis. However, this is an unregulated field of business. The turnover rate in this field is high and you may assign a judgment to someone that is nowhere to be found tomorrow. Many of these businesses operate from a P. O. Box.

No training is required to open shop. Generally, these people purchase a course on judgment recovery and proclaim themselves as experts in this field. The course typically includes marketing letters, a web site template, basic forms and assignment agreements. No legal training is provided. These businesses typically obtain a business license from a local government; however, this field is not regulated and any certification they may claim to have has not been granted by the state.

You will be required to assign ownership of the judgment to them with the added expense of a Notary Public. You lose all right, title and interest in the judgment when you assign it and will no longer be a party to the judgment. You have no voice in the matter should the specialist decide to settle the case for less than what the judgment is worth.

The Fair Debt Collection Practices Act prohibits communication by debt collectors regarding the debt to non-specified third parties. Thus, you will not legally be able to find out what is going on with the collection of the judgment. Attorneys, however, are permitted to discuss the case with their client. Other problems arise when these people use their spouse to notarize your signature. A Notary may not notarize a signature when they have an interest in the subject. California is a community property state and the spouse has an interest in the assignment, leaving it vulnerable to a challenge in court.

7. WHAT TYPES OF JUDGMENTS DOES BALIS JUDGMENT ENFORCERS ACCEPT?

We accept all money judgments, including unlimited civil, limited civil, unlawful detainer awards, small claims judgments, family support, spousal support, child support and equalization judgments. We also accept criminal restitution cases, sister-state judgments and Labor Commission judgments. We accept cases from both businesses and individuals.

11. WHAT FEES ARE INVOLVED?

Contingent fees are percentage of the amount of your judgment(s) that we are able to recover from the judgment debtor. Several factors are taken into consideration in determining the percentage, including the age of your judicial judgment, the amount of your judgment and the judgment debtor's specific profile.

12. CAN BALIS JUDGMENT ENFORCERS GUARANTEE I WILL RECEIVE MONEY?

No.

No one can (or should) give you that guarantee-and if they do they aren't being honest with you. For example, if a debtor has died, or if a corporation dissolves, there may be no assets for Balis Judgment Enforcers to act upon or seize. Some people or companies are, it is sad to say, ‘judgment-proof’. But we can (and do) guarantee that we'll never give up working for you! We stick with you every step of the way. 13. HOW LONG WILL THE ENFORCEMENT AND RECOVERY PROCESS TAKE?

This depends on a number of case-related factors.

The process can, in some cases, be completed almost immediately, but more often than not it will take a few weeks or months. It ultimately depends on the age of the judgment, the size of the judgment, and the judgment debtor's profile. Regardless of how long it takes, Balis Judgment Enforcers never gives up and will pursue the debtor until we enforce and recover your judgment or we discover that it is impossible to recover.

14. CAN I RECOVER INTEREST ON MY JUDGMENT?


Yes. California provides 10% interest by statute. Except under certain circumstances, this rate is not compounded.

15. HOW MUCH IS MY JUDICIAL JUDGMENT WORTH?

Your judgment is worth the amount that the court of record originally awarded you, including costs awarded, interest, and any other court authorized expenses that may have been incurred to enforce and recover your judgment. 16. HOW WILL I KNOW WHAT IS HAPPENING WITH MY CASE?

At Balis Judgment Enforcers we take extreme pride in our every attention to detail. Once you have met our requirements and we accept your judgment for recovery, we will keep you updated of any enforcement and recovery action taken or progress concerning your case, and we'll provide you with copies of and the receipts for any of the fees incurred during enforcement and recovery of your judicial judgment. Our policy is to communicate with all clients on a regular basis to keep them apprised on the progress of their case. Feel free to call us or email us with questions regarding the status of your case. Be wary of non-attorney’s who promise to keep you informed of your case should you decide to utilize a judgment recovery person. The FDCPA prohibits communication of a debt with non-authorized people. If you assign your case, you are no longer own the judgment and the non-attorney judgment enforcer may be in violation of the law in communicating with you.
